A 43 year old man has appeared in court to face charges of driving while almost four times over the legal blood alcohol limit.
He was also charged with assaulting a police officer.
As part of Operation Christmas-New Year 2023, officers attached to Liverpool Highway Patrol were called to a fast food restaurant in Edmonson Park where the driver of a utility who was allegedly intoxicated was using the drive through.
Police say they stopped a white utility on Rickard Road, Leppington and spoke with the driver.
He underwent a roadside breath test, which allegedly returned a positive result.
The man was also subject to a roadside drug test, which allegedly returned a positive reading.
The man resisted arrest before he was taken to Liverpool Police Station and underwent a secondary breath analysis which police allege returned a reading of 0.198, just under four times the legal limit.
Police allege in court that the man failed to comply with a secondary oral fluid test and threw a swab at an officer, striking their forearm.
The man was charged with driving with high range prescribed concentration of alcohol, refusing or failing to provide oral fluid sample, assaulting a police officer in execution of their duty and two counts of hindering or resisting a police officer.
He was refused bail to appear at Parramatta Local Court on December 23).

In a separate incident, the driver of a car has died of injuries he sustained in a single vehicle crash at Prestons a week earlier.
The incident occurred on December 15, when emergency services were called to Jedda Road, Prestons, following reports a car had collided with a power pole.
NSW Ambulance paramedics treated the driver and sole occupant of the car – a 27-year-old man – at the scene, before he was taken to Liverpool Hospital in a critical condition.
Officers attached to Liverpool City Police Area Command established a crime scene and commenced an investigation into the incident.
About 11.40am on December 22, the man died in hospital.
Police will prepare a report regarding the man’s death for the information of the Coroner.
